resolv.conf has other dns setting than etc/config/network

Description

I notice resolv.conf has the dns setting given by the dhcp server (which is incorrect) and power led will go orange and tell me internet connectivity is down erroneously;

I've configured static ip with the CORRECT dns server ip; verified in /etc/config/network

i'm running 2.2.6rc1
